I also traded emails with the non-U.S. lawyer for a client for whom I am doing some real estate work.

These two exchanges reminded me that there is another legal planning consideration that should be remembered, quite apart from tax.

That other consideration is probate. In lay terms, this means “Who gets your U.S. real estate when you die?”
